This has inspired me to continue with my previous thread "Motgages - where is the consideration?". I have already requested access to view the original "note" and the bank has told me to get legal advice aka refused.

In addition I am willing to carry the task in this thread for a credit card and act as guinea pig purely to shut asky and no6 up

I have already requested access to view the original "note" and the bank has told me to get legal advice aka refused.

I think a request such as you have made is not a valid offer in order to demand production of the mortgage.
Thats why the bank directed you to a lawyer.
Now as letter # 1 stipulates the offer is on stage as an offer to pay pursuant to the tax laws.
An offer no bank can refuse.

And what do you propose assuming that the bank IS willing to provide me the original note? Or to put it another way, calls my bluff?

Also, why can't a bank produce the original note (assuming they haven't traded it)?

1) The bank NEVER sells the note.
2) The bank sells a security interest in the note to a third party.
3) The mortgage note for legal reasons no longer exists.
4) The original instrument of indebtedness is not in its original form.
5) The mortgage note is now a bearer bond/bearer instrument by the fact it has been endorsed.
6) The party who physically holds the bearer bond/bearer instrument is the legal owner of everything listed on the bond even after you have legally discharged your obligation to the bank.
This is all easily verifiable with a legal and financial terms dictionary.

The only possible way that a bank would bring the mortgage note to a court room is if the mortgagees counsel has the mortgagors counsels consent to not dispute the fact the note is no longer a mortgage note.
I found a couple of examples of that happening in the U.S.

I suppose it may be a reportable event concerning national security in Britain if "in fact" it did "work".
I suppose it may even make it all the way to Jonathan Evans.

You are correct, yozhik I don't believe the offered method would work to settle a mortgage. That is precisely the reason why I asked the OP has anybody used this method to successfully settle a mortgage.
I consider it strange that a thread is started which claims to offer a soloution and yet when the OP is asked about the validity of the soloution the response is "why would you wish to know?" I would have thought that many would wish to know if the soloution works. Would it be preferable if everything that is posted on this forum is taken as fact, not questioned and accepted as a proven method? I note that the OP declines to confirm personal knowledge of success of the method.
