It depends on the statute.

But in almost every case if the statute has a cap on liability, that's it. No one will be paying the 2.5 million.

Statute prevails over and displaces common law.

But there may be a loophole if the legislative draftsman has erred. Or the the statute may not be intended to oust the common law jurisdiction.

Common law is essentially judge made law. It developed through the centuries via precedent. That is, once a court had pronounced a decision then the nature of the ruling would be followed by subsequent courts.

By way of example, the first (or one of the very first) common laws developed was contract law. The first courts developed the principles that for a contract there needs to be:

1. Intention to be legally bound.

2. An offer.

3. Acceptance of that offer.

4. Consideration for the promise. i.e., you offer me $500 for my car and I offer my car for your $500. Quid pro quo.

However, once parliament developed, this body took on law making powers. To reflect the will of the people.

This law making power extended to replacing judge made, or common law. As I said, Statute prevails over common law.

Statute and Common Law (Final).pdf (uq.edu.au)

To use my contract example above, there was a doctrine in contract law called privity of contract. That is only parties who had provided consideration could benefit from the contract.

That rule was displaced by the Contract Rights of Third Parties Act (or something like that). Now if a party is named in the contract, as benefitting from the contract, they can sue to enforce its terms notwithstanding they had not provided consideration for the promise.

Common law still applies where it has not been displaced by statute.

And where ambiguous, statutes will be interpreted according to common law principles.

So there is still some overlap.

But if a statute clearly indicates that it replaces common law then the common law is gone.

The suggestion that you can stand up in court and exercise your common law jurisdiction to oust the statutory jurisdiction of the court is witchcraft.

I have looked at many of these types of arguments over the years. Because I want them to be true. Unfortunately they are all based on some fundamental misunderstanding of the law.

But I am open to evidence and would love to be proved wrong.

That is not to say we shouldn't be vigorously saying we do not consent. We should. I am just saying don't be disappointed when a court doesn't find that argument particularly compelling.

I, for one, am not going to consent.

The link you have provided is an Australian one but I assume that it would apply to the UK as well?

Are you referring to the legislations or acts when you say 'statute'? Sorry for such basic question.

Yes, it would apply equally to the UK.

Australian law is based on and follows a lot of UK law.

Australia started to diverge in the 1980s but before then everything is relevant. So the arguments in that article would apply to the UK.

But here is a link to England and Wales.

Edit: Statutes, legislation and enactments (acts) are all the same thing. Laws passed by parliament.

I remember discussing 911 with a girl a number of years ago. She was a believer in the government narrative. I offered her $10K if she could prove that a plane hit the Pentagon. That was back in the days when I had money.

Instead of jumping at the chance to earn $10K she just got really angry and refused to participate.

It was actually quite an extraordinary reaction.

But one borne out of being completely conditioned to the government narrative.

I had a similar experience with a covidian. Not sure if you're familiar with Samuel Eckert, well he's offering 1.5M euros to anyone who can prove evidence of the existence of a coronavirus...

1.5 million € for a virologist who provides scientific evidence of the existence of a corona virus, including documented control attempts of all steps taken to provide evidence.

Great, the bet stands!"

So when I put the above to the covidian he twisted it and replied with, "Can you prove it doesn't exist?"

After going through basic concepts such as burden of proof and not being able to prove a negative he threw a paddy, toys in the air and everything!

Yes, really.

The New York Times - one of the biggest and famous newspapers in the world - is officially claiming cat memes (not even "nasty" "right-wing" memes that the EU officially wants cancelled) - but fucking cat memes - are a threat to democracy.

Just when I thought the Czech president in a plastic box wasn't enough.

I suppose there is nothing people who refuse to see the media as the driving force of lies and deception and still hang on the "official" "authoritative" narrative will not believe.

Donald 'Biff' Trump was said to have excitedly exclaimed 'Oh, Macron!', when Emmanuel first whipped out his todger in front of him, at a masonic social. I reckon a pensive Whitty, sitting in the corner, just misheard and settled on it (in both senses). Cheers, Biff.

Nah, I realized they questions you posed were rhetorical. 🙂

Thank you for your kind words, truly appreciate it🥰

See these posts, but wouldn't hurt me repeating the attachments here again.

References to Steiner's quotes and more material

“The spirits of darkness are now among us. We have to be on guard so that we may realize what is happening when we encounter them and gain a real idea of where they are to be found. The most dangerous thing you can do in the immediate future will be to give yourself up unconsciously to the influences which are definitely present.” ~ Rudolf Steiner

If people express the natural human inclination toward spiritual growth, they free themselves from fear and anxiety, and effectively develop a sort of immunity to the influences of negative entities. If not, our vibration attracts hostile spirits and we fall unconsciously unto their influence.

“There are beings in the spiritual realms for whom anxiety and fear emanating from human beings offer welcome food. When humans have no anxiety and fear, then these creatures starve… If fear and anxiety radiates from people and they break out in panic, then these creatures find welcome nutrition and they become more and more powerful. These beings are hostile towards humanity.

Everything that feeds on negative feelings, on anxiety, fear and superstition, despair or doubt, are in reality hostile forces in supersensible worlds, launching cruel attacks on human beings, while they are being fed. Therefore, it is above all necessary to begin with that the person who enters the spiritual world overcomes fear, feelings of helplessness, despair and anxiety. But these are exactly the feelings that belong to contemporary culture and materialism; because it estranges people from the spiritual world, it is especially suited to evoke hopelessness and fear of the unknown in people, thereby calling up the above mentioned hostile forces against them.” ~Rudolf Steiner

The fall into such  destructive slumber would be marked by an age of materialism and centralization of power, during which the influences of ‘spirits of darkness’ would inspire humans to devise new technologies and new means of oppression. Steiner comments:

“I have told you that the spirits of darkness are going to inspire their human hosts, in whom they will be dwelling, to find a vaccine that will drive all inclination toward spirituality out of people’s souls when they are still very young, and this will happen in a roundabout way through the living body. Today, bodies are vaccinated against one thing and another; in future, children will be vaccinated with a substance which it will certainly be possible to produce, and this will make them immune, so that they do not develop foolish inclinations connected with spiritual life – ‘foolish’ here, or course, in the eyes of materialists. . . .

“. . . a way will finally be found to vaccinate bodies so that these bodies will not allow the inclination toward spiritual ideas to develop and all their lives people will believe only in the physical world they perceive with the senses. Out of impulses which the medical profession gained from presumption – oh, I beg your pardon, from the consumption [tuberculosis] they themselves suffered – people are now vaccinated against consumption, and in the same way they will be vaccinated against any inclination toward spirituality. This is merely to give you a particularly striking example of many things which will come in the near and more distant future in this field – the aim being to bring confusion into the impulses which want to stream down to earth after the victory of the [Michaelic] spirits of light [in 1879].” ~Rudolf Steiner

I have just had a phone call from my local surgery asking me to come in to get a Shingles shot. WTF ! Nothing in my medical records refer to any need for such a shot. I am suspicious that they are inviting me for the purpose of giving me the CV shot. I have no evidence, of course, but it seems mighty strange. I am writing this just in case other people have a similar experience. Naturally, I told them I am not interested in their 'offer'. Not at the moment anyway. It could be a genuine invitation but right now, I am not up for it.

Are they playing tricks now ?

MHRA has blood on its hands. They obviously approved this mRNA with little concern for people's safety. The acceptable risk was not reasonable and the benefit does definitely not outweigh the risk. The corrupt cunts need holding responsible for it before they damage the health of any more people.
