The pollution just adds to the pollution. The problem with chemical legislation is that it allows companies to do their own (minimal) testing before putting a new one on the market. Years later, it's proved to be toxic and banned but Big Chem already has the near-identical replacement on the market. Du Pont lost their case re Teflon - but it took 27 years and millions of dollars to (not entirely) prove they were guilty.
