If you're looking to issue, you need to follow CPR 7 for issuing claims. Particulars of claim might be quite tricky, hopefully you don't need to get that far because the protocol letter may well be enough for him to see that you're serious.

What price do you reckon I should seek..top is 9k in court.

This has been continuous harassment & discrimination over two years, including a threatening letter from them for being rude to staff ending in refusal to enter surgery.

I am eligible under the equality act as disabled also.

I was thinking 3k, but for a quick settlement maybe 1k.

Dunno, good question. Could put £5k down and go to £1k if needs be. Just make sure you use the template letter quoting the relevant passages and that should get the ball rolling.

Sorry. So you send your protocol letter which will state as per the protocol, they have 21 days to respond to your claim. If they don't, by right you can issue proceedings without actually addressing them further. However, what I was suggesting is giving them a further 7 days in writing that if they don't respond you'll issue proceedings, thereby looking good to the judge. 

 

All this should be in writing and is fine by first class post. CPR 6 deals with service and Postal service is standard. Especially since you won't know if they'll accept electronic service. So post to be safe. You allow 2 days postage and the start your 21 days. However, be careful, because 2 days postage won't count of it starts on a weekend if I remember rightly. It's all there anyway. Also keep a count of how many communications you are sending, all good for costs. However they will be fixed by small claims.

I think the damage is done ,people have become so complacent and  used to wearing a mask it has become second nature,and the main reason when talking to them,I don't want any aggravation,it's easier to ware one ,just like I don't want the vaccine but I want to travel etc.

Well if that's the case they get what they deserve ,what a bunch of pussies, if they are worried about some over zealous employee or government official, or some self righteous idiot from the public what will they be like  if shit really hits the fan

Do you have an anti discrimination dept of the government, I don't know how it works over there but it seems to me if you put in an official complaint with them and they upheld your complaint and you have indeed been discriminated against any further court action with regards to the value of damages would be backed by this previous judgment

You could go that route Peter & above their heads, but I feel they would mess me around & wouldnt lead anywhere. Best to give them a letter of notice to prosecute. I have the letter filled, but still not made mind up about compensation. A thousand would be looking for an out of court settlement. 3000 I feel they will go court over & laugh at me. And im not confident after Dale & Morpheus posted the links on court procedures & etiquette, but solicitors always seem to be not interested in these cases & ive contacted a few now.

I might get torn apart in court with a good lawyer, but I dont want to let them get away with it either.

Like I said I don't know what its like over there but here but here they take anti discrimination seriously ,I've been in touch with them 3 times now I carry their  number in my wallet just for cops overstepping the mark ,they said any problems let us know and they sent me official complaint forms  I have told cops to ring the number when I been hassled about not wearing masks and not signing in etc and straight away they have backed off so they obviously know the mandates are bullshit. I don't know how they would treat you,but maybe I don't think it would hurt to inquire. Like I said if you are to prepared to spend the money on lawyers  having the backing of a government judgment in your favor can only help your cause

That's right. Sorry, I forgot to mentioned this in my previous post.

No solicitor wants to take it on if it's Covid related because there hasn't been many cases hence it is likely that you have to DIY.

That's the thing. If you went ahead, other people could be helped simply because you took the opportunity to put things right.....otherwise BS is allowed to continue. I'm telling you, money is the only way to shut anybody up because it hurts.

 

There are two components. Out of court settlement was made £7K and you could also claim injury to your feelings £1K+, make it max of 10K so that you don't have to pay the Defendant's legal fee. Anything over that, you could be asked to pay. 10K isn't a great deal of money when it comes to compensation. People have been awarded 6 figure sum in work related discrimination which many people have started....e.g. NHS workers etc.
