It could have been done over the phone but for some reason it was scheduled as an in-person conference. She went with her client, who suffers from Emphysema, is on oxygen, and can barely walk. When they arrived, the security guard pointed to the mask requirement but took pity and waved them in. The adjudicator however, demanded that masks be worn. My colleague told the adjudicator that her client could not and would not wear a mask. The adjudicator stood up, walked out of the room and is now threatening sanctions. Nemuri Kyoshiro Posted February 6 Share Posted February 6 Follow-up to last Thursday's post. I received a phone call from the chief judge this morning. I get on well with her. She said that it is up to each individual adjudicator as to how they deal with mask issues and they have fairly broad latitude. I was told that walking out of a hearing room was unacceptable and she asked me what I would like to do about it (I have taken over the case from my colleague). I asked for a change of adjudicator (granted), and a hearing date in the next two weeks (also granted). The chief herself will hear the case and no masks will be required. She also suggested that I file a written argument that might help her expedite matters. It boils down the fact that they don't want us to file a discrimination case. As long as my client gets taken care of, then I won't take any further action. Observations Posted February 15 Share Posted February 15 Went to the surgery today In one waiting room one out of the three wore a mask, in the other waiting room, one older couple walked in with homemade face masks, no-one else had one on. Both receptionists were behind the awful perspex, without masks. Went to the hospital afterwards; the majority wore masks, although some staff didn't which was a litle bit encouraging? I saw too many rainbows; pedestrian crossings labelled 'cross with pride', and a big poster advertising rainbow pin badges, describing how it shows the hospital is inclusive and welcomes everyone.
