Aye joe nada Posted December 7, 2020 Share Posted December 7, 2020 Hello guys can anyone help with recommendations for getting help with workplace discrimination I am medically exempt from face coverings and my work will not accept this and placed me on furlough, I have provided written proof to my work place to show I am exempt which I did not need to do but they threatened to take me off furlough with unpaid leave if I did not comply with there demands and even tho I have done this they still won’t allow me to work I want to expose the tyranny of this company they are part of the bigger problem of what’s going on in the world they are making up their own tyrannical rules any help would be appreciated we need to out these kinds of businesses . Depending on your profession and the environment you work in, you could possibly have a case for 'constructive dismissal'. However this might be difficult to follow through, especially as your employer has already placed you 'on furlough'. While you may not be allowed to do your job, you are being fully paid (or should be), so there may not be much you can do about this. I had a discussion with my colleague at work the other week, in which I detailed out what I would have done if our business had been forced to shut down and I had been 'furloughed' on full pay - believe me I am grateful that this hasn't been the case and that I have been able to continue working as normal throughout this situation, but I would seriously have made the most of the 'free time' to explore and learn new skills... rather than lazing around on the sofa watching daytime TV. If its just the case that you want to do something to occupy your time, find a part-time job or do some volunteering. You seem to be in the UK, so if you want some serious advice, you might start with something like the Citizens Advice Bureau, unless someone else here has any additional insight or thoughts. I will continue to try and get some awareness raised to my situation masks don’t protect us anyway all about obedience. Yea I’m making good use of my time I was on furlough during the first lockdown I’m only on it now for the reasons I explain in my original post . Thanks for your input. Aye joe nada Posted December 8, 2020 Author Share Posted December 8, 2020 I have a legitimate medical exemption in writing from my GP which I have given to them and they still place me on furlough you don’t need to be careful when your speaking truth I will not live in fear or be bullied by corporations who are tyrants making up their own rules but thank you for your concern I’ve taken legal advice and have a case if all companies acted like this one I would not be able to leave my house . wake_up_bomb Posted December 8, 2020 Share Posted December 8, 2020 I can give you one piece of advice. Get everything in writing. I assume what you've stated in the OP was conveyed verbally. There are very strict laws about discrimination, and you simply cannot discriminate openly against someone for having a disability or medical condition. Of course, in practical terms you can easily discriminate against them, not least by not hiring them in the first place. You just can't say that you're doing it! If you are 100% certain that you have a valid medical condition, and you've made it 100% clear that you will work and will be cooperative in any reasonable way possible, they have to find a practical way to enable you to conduct your normal duties, particularly as your workplace is seemingly open as normal. Aye joe nada Posted December 8, 2020 Author Share Posted December 8, 2020 I have all the emails , I also have video recording, and most importantly I have a written letter from my GP which exempts me from face coverings it’s all legitimate and above board the way they are acting is totally unacceptable they asked for proof which I did not need to provide by law I only did cos they threatened to take me off furlough and place me on unpaid leave they got the proof and still kept me on furlough Ive said I want to come back to work they won’t let me as they can’t make the right adjustments for me also discussed alternative job role and they said were placing people back on furlough soon anyway so I can’t come back anyway why ask for proof to then not allow me back in it seems like discrimination to me I don’t think they like the fact that I stood up for my rights it’s the kind of place do as we say or your out . And they only put me on furlough cos they would not accept I was medically exempt until I proved it and still I’ve done this like I’ve explained totally frustrating and very unreasonable thanks for your input.
