In fact: if you look at the RULES OF ENGAGEMENT for a Declaration of War, you really need to identify the enemy before engaging in War. If you don't, you get the lurid VIETNAM situation where ANYBODY (hence, EVERYBODY) has to be considered VietCong i.e. the enemy and innocent women, grannies and children are 'justifiably' murdered in the name of armed resistance against a foe.
Bad news is, under Article 44 of the Anti-Terrorism (I'll not call it legislation) dogma, ANYBODY (hence, EVERYBODY) has to be considered a terrorist, guilty by legislative-association and shouldering the burden of innocence-proof i.e. an accusation that's impossible to refute.
