View Full Version : Banks may be forced to pay back unfair charges

A decision will be made next Wednesday; and if successful, it means that you can tell your bank that you want ALL of your statements going back 6 yrs and demand a refund all those nasty £38.00 odd chrges they dish out if you go o/d or if a d/d fails/cq bounces, etc. You are allowed to add 6% interest as well.
I claimed mine back a couple of years ago (£2,400 in total) thanks to the help of a consumer forum. :D The only cost involved was a fee of about £38.00 to the local county court.
Given this latest news I now have my sights set on a catalogue and store card.:rolleyes:

I do hope so..its taking long enough.
Im still waiting for my decision from A&L they said they where waiting for a decision from the courts thats been ages ago..with them appealing against the last decison from the courts.. I used the template letter ect from moneyexpert they said to add 8% which I did.

Thanks for this dude. Put in a claim around 2 years ago backdating 6 years, so its 8 years now since the cnuts have continued with the charges. Should be a few K in it :D

if its decided that they do owe all the money , then im betting a quid that the banks will appeal and it will get delayed for 2 yrs...
so dont bank on it to soon!!

The Banks have already said they will appeal - this is the 1st part of a 2 part process - they reckon it will all be sorted in 2015.
This first part is only to decide whether the OFT can demand the Banks make payments back to customers. They then have to decide how much they can demand the Banks pay back.

This is the bill which was put back for the general ellection was it not, we are in one of the deepest recessions since the early part of the last centuary, so I don't think we will be seeing any refunds just yet, the total sum reaches into many many billions, it would be as bad as another huge bail out, many banks banks could go bust if this comes to pass.
Care to share detailed analysis of how you did things, I have got all the bank statements so far, what do you have to do next, much appreciated for any help you can give me and the rest of us in a similar pickle ;)

If you are in financial hardship... i.e your incomings don't cover your basic outgoings, your bank is obliged to process your claim immediately and refund you the difference out of their ill gotten gains.

No problem;)
1. use a highlighter to highlight EVERY single charge due to being o/d, etc.
Total up. (This will need to be applied on to an excel spreadsheet so interest can be added (and as one person on here said - yes, it's 8 per cent, not 6 as I thought).
2. Send the bank a letter with the spreadsheet telling them they have 28 days to put it back in your account, charges unfair, etc or you will file a claim through county court.
3. On day 28 they will prob' write to say they are dealing with it.
4. Write again giving them 7 days, or else.
5. They will give you an offer (about half of what they owe you). Accept it in part payment and begin cc action (online is quicker). Fee was £38.00 when I did it.
6. Await court hearing date. Phone them and hassle about 2 weeks before hearing.
There are 2 really good forums; both have all the template letters and spreadsheets that you need, and everyone is really helpful. I'll google them now and post the links.:D

Yes, you are right. My 21 yr old son (a uni student) did this but Halifax threatened his account with closure if he went o/d again - better to do it all in one hit.:D

backdated 6 years. That may be just enough for me. I've lost shed loads due to charges on various accounts. One affected the other so to speak. Bit like a chain of defaults all started due to over the top bank charges on a current account.
