View Full Version : parking charge reply - still waiting....?

Dear forum, i marched towards my car frantically as i knew what was happening, i could see it unfold in front of me, the fat inspector out of thomas the tank engine was writing me a fix penalty charge for being 12minutes over my allocated time for use of a parking space in the town centre, Reluctantly i whipped the ticket from under the wiper, i was annoyed but happy at the same time as this was my first chance to use freeman for a parking charge. I sent off the ticket with my "Notice of Discharge of Outstanding Fixed Penalty Charge and Request for Clarification" I gave 7 days to reply but that was 4 weeks ago.........Where do i now stand - i have had no reply from them, the city council or any debt collection agency and i am eager and excited to find out whats going on - do you think i should just leave things the way they are now? Is it settled or should i chase it up??

Leave them be and wait and see, you will probably get a different letter saying that you owe more moneys, then the next step will be bailiffs, keep fighting them with thier fire and hopefully in the end you can win the small tedious game that they play.

I personally wouldnt wait for their reply, i would write to them and say the time limit you set has expired so you now consider the matter closed as they went into dishonour.. or something similar to that.

Doing this will stop any controversy, as you have asked for proof, they failed to provide so you are informing all parties of your position. If it goes further this second notice would be proof you upheld your side of the issue.

if they can be bothered with this, they will just issue a new notice saying that the notice saying that their notice was issued correctly yada yada yada. so basically they normally just ignore what ever notice is sent back to them. so there's a number of avenues you can go down if they do send a new notice:

1. Not Recogised. Return to sender.
2. Refused for cause [some people have done this and claim it works, but its a legal term which im not happy about using]
3. I waive the benefit privilege of the offer to pay, and as consideration i offer to...... (whatever it is you want to offer, ie relief of duty to perform, or God's peace and love, etc)

You've served them your notice, dont do another thing. Just wait.

I gave the DVLA 7 days to reply to my notice, they replied in three, with another demand for payment. I left it. My original notice was sufficient. You keep writing to them, you're performing for them again, giving away your energy, which is something you intend to avoid. They're just fishing now, seeing if you'll bite. If they make anything of it, make sure you have copies of the letters you sent, maybe even mail a copy to yourself, like the old makeshift copyright procedure. Then you can produce a postdated copy of your correspondence for any further demands.... 'see, ive already dealt with it, stop wasting my time.'
