ok, so Bank of America has turned my strawman's false "debt" over to I.C. System - a 3rd party collection agency that, according to their website, "has been helping clients achieve their accounts receivable management goals.". HA!
needless to say, they will be receiving a classic '3rd party dismissal' letter.
at this point, can the bank "take back" my strawman's yet-to-be-proven "debt" from this 3rd party agency? or did the agency buy it from them?
btw, check out www.icsystem.com. they started out as a husband and wife duo, cleverly contracting people to pay up. the business just grew from there. from experience, they have some slick people speaking on the phone who are really dedicated to their job - which is getting you to contract with them. they did not succeed with me, however. sleaze balls. also, on their homepage is a telescope - "I.C." System;)

There's a great quote from Mark McMurtrie (in Australia), where a third party debt collector (obviously a bit green) turns up at his door and states:
'Hello, I'm from XXXXX, we just bought your debt from YYYYY...'
'Well, that was a bit fuckin' dumb, wasn't it?'
*door slams....
I don't know is my response to your question.
(Maybe they have a clause in their contract whereby if the DCA can't collect the debt in a given time period, the bank will buy it back).
I do know that in the UK, such a third party interloper is issued a 'deed of assignment', which is numbered (a contract? NO, deed=ownership) and if they (the 3rd party) can't or won't produce this when you ask for it....you can safely (and politely) tell them to stop bothering you....

when the debt collectors finally crack the shits and give up, they'll sell it back to the bank, who will begin harrassing you. don't answer the phone, just send a request for proof of claim (a copy of the legally binding contract) and state your willingness to offset any true, lawful debt.
i'd suggest sending a Friendly Notice to Dun and Bradstreet or whoever to notify them you've had the claim made by the bank and that you're happy to pay any true debt (but that you don't consent to any defaults being filed that may harm your capacity to function commercially, and that if any such unlawful default is filed that you will seek legal remedy). provide them with a copy of your own correspondence with the bank (and proof of mail delivery ain't a bad idea). that way if the bank tries to fuck your credit rating by claiming a default, they will look awfully stoopid and you'll be one step ahead by having already notified D&B of your honourable intent. :D
EDIT: if you accidentally find yourself on the phone to anyone trying to contract with you, don't tell them anything except to send all lawful correspondence IN WRITING (don't identify yourself and don't answer questions - ASK questions, that's what creditors do). hope you have an answering machine. i enjoy it now - every call they make costs them money because of the machine and yet they speak to noone. ha! fuckers...
