Forced Catheterization Used In DUI Case

LAWRENCEBURG, Ind. -- An Indiana man has filed a lawsuit claiming that police forcibly withdrew blood and urine from his body during a drunken driving arrest, WLWT-TV reported.

According to the suit, police arrested Jamie Lockard, 53, on suspicion of drunken driving in March.

A Breathalyzer test showed he was under the legal limit, but Officer Brian Miller doubted the findings.

Lockard and his attorney claim in the suit that police took him to Dearborn County Hospital and forced him to submit to a urine and blood test.

Police said they obtained a warrant, but Lockard's attorney said his client was shackled to a gurney and had a catheter inserted against his will.

"It has to be executed reasonably," said attorney Doug Garner. "No one would say this is reasonable behavior. It's reprehensible that anyone could think that this is appropriate."

The blood test showed that Lockard's blood-alcohol level did not exceed Indiana's legal limit, police said.

Garner said the police officer did not apologize, but instead charged Lockard with obstruction of justice.

"He took it too far. He thought he could do whatever to me," Lockard said.

The suit names the Lawrenceburg police department and Dearborn County Hospital, in addition to Miller and Dr. Ronald Cheek.

"I would hate for this to happen to someone else," Lockard said. "It was the most humiliating thing that has ever happened to me, ever."

That's completely degrading. What the hell is wrong with a majority of the police force today? It's pretty clear that very few of them have the interests of the public in mind. It's no wonder people are hesitant to get police involved in anything.

Well maybe its because of news articles like these which are attacking the police, and have been so common in the last year or so, in the mainstream media. I mean there is an obvious agenda going on where the divide between the state (police) and the "people" (i use quotation marks as 40% of the workforce work for the state)

Yes its obvious corruption should be highlighted, and DEFIENTLY signs of the police state but i can think of many other organisations and certain individuals that are probably commiting worse acts than the police. And if they were rather too focus on the cause of the police state rather than the effect such as schools/councils monitoring parents with cctv and survailence, and 5-0 nicking or giving you a fine for saying Blair is a wanker. I am saying this as there was very little attention on the laws (statues? bliar passed, which even many lawyers and cops don't know about this day.

Yes many people choose not to call the police or ask for help, because its too much hassle for what the crime is worth, doesn't necessary mean they are criminal . However when people's cars get stolen that usually gets reported, due to insurance where the money is at :P

Yes, because he altered the state of his blood and urine to avoid being caught.

Wow. Things are getting more and more ridiculous every day. Every time I think, yeesh, well, at least things can't get much crazier, something like this happens. Yikes. :(

I am saying this as there was very little attention on the laws (statues? bliar passed, which even many lawyers and cops don't know about this day.

I can not believe anyone is "told";

"breath test them ... if its negative, take them to the station and get a blood and urine sample ... if they won't give it, tie them down and forceably take it via a urethral catheter ... if that test comes back negative ... arrest them for obstruction of justice ..."

Even if a normal human being was "told" this; they'd tell the person giving the message to fuck off.

Could it be that these stories are allowed to come out not to show how badly the state is treating people but to as a warning by them that they can do whatever they want to you?

My mate had a blood sample taken WITHOUT HIS PERMISSION when he was caught drinking and driving. He was paralytic at the time so he couldnt blow into a bag. He got banned from driving and got a fine. His solicitor said to my mate (as I did) that the policemen who took the sample should have been sacked and prosecuted for GBH (or something like that), no matter whether the defendant was guilty or not guilty of the offense. But his solicitor doesnt seem to have brought this up in court.
