I got a question

I am 33, have worked for my present company eight years. Seven years ago I was diagnosed with rheumatoid arthritis. Recently I've been off work ill for the last 3 months with my arthritis condition. I have handed in medical certificates to confirm my illness.

I have had a number of meetings with HR, & discussed light duties. I have said I'm to ill to drive.

I have been to a meeting earlier today with HR and management, both present.

In this meeting I find they have used a private detective to gain information on me (i.e.. following me, taking pictures/video footage). I was shocked to find out, This includes for the last six weeks at least, I had a 'Tracking Device' attached to my car, with out my knowing.


Is this even legal.?

I had the same with a previous company in 2001/2. Ask the CAB, they might be able to help.

And what was your outcome.?

I'm going to see a solicitor tomorrow for free advice, cause the CAB round here are not helpful.

the cab are suspect here too....lawyer for advise then tpuc.org for law.....

i am astounded because how come the people who tell the truth up front

are now being treated as criminals being followed and tracked is uncalled for in your case......seek and eventually you will find some answers......:eek:

That's incredibly disturbing, legal or not. I don't think some of it is legal. Attaching devices to your car without informing you could be deemed tampering with private property, as well as trespassing on private property.

If I were you, I'd ask to get a copy of your initial application to where you're currently employed, and look over the terms of agreement with a lawyer. They may have slipped that bit in with background checks. If it's not listed, and you didn't agree to it, then I believe you could seek legal action.

They do it all the time when it comes to short term or long term disability as well as regular old workman's comp. Is it legal? I don't know. But it is a common practice. Insurance companies and employers don't like payouts.

Spoke to friends about the situation. They also are wondering about the legality of it.?

From info they disclosed in the meeting, I have been tracked for the last six weeks, they had a folder full of evidence that they wouldn't show me.

It as made me so paranoid about the use of bugs and phone taps now. I know that is extreme, but I never thought they would stoop to the depths they already have...

I have got to go back next week for a second hearing, then after that a disciplinary.
I friend said it will be impossible to work back there again, so I should hand in my notice of resignation..


Any thoughts.?

If it has now caused you to develop paranoia. Then claim away and go off sick! Everyone has the right to privacy. It is an infringment of your right to that if an employer sticks a tracker on your own car. If its a company vehicle then they can do what they want with it. Ensure you have evidence of what has casued this paranoia otherwise the doctor may say that you er have paranoid delusions.

This is terrible news - but not realy surprising.....

I hope you get some kind of resolution - screw the bastards in any legal way you can.... you have nothing to lose, as you have said it would be impossible to return to work.....

string them out as long as, and in whatever way you can.

think about it like this - do you realy want to be employed by people who will stoop so low?

Keep in the back of your mind and remind them that even though you are too ill to work, which is verified by your doctor, you are not too ill to live. If they do not believe you, then they are basically calling your doctor a liar. Ask your doctor what he/she thinks about that.

Just spoke to the regional union rep, he as seeked advice from somebody. He said, they (my employers) are in their rights to hire a PI to follow me and track my car if they have reason to believe I was de-fruading the company..

He said off record, I'd be best to write an apology and include my resignation. But then they could still pursue a fruad claim...

I say again that if the car is your private property and they placed a tracking device on it. That they invaded your privacy. Which is a breach of your human rights as granted by the EU/UN.
