I have a Mortgage on a flat which is Leasehold.

What happens if they recind the lease?

Been here for years. What authority do they have over the inside of my property?

I would really appreciate some advice.xx

who holds the lease

do you have a contract/copy of the lease, eg the terms and conditions.

Basically we were looking after a cat. Somebody may have seen him at the window. There is a no pets policy. But he didn't go outside.x

What colour is the cat?
Does he like ice-cream?
Has he got a criminal record?

These are all things you will have to think about if this goes any further.

if it said no pets on the lease, they obviously have grounds.

if someone has grassed you up, then what can you do.

if the cat is temporary, return it to the owner, and deny everything to the landlord.

unless the grasser has evidence/photos. even then you can say cats are migratory animals, they often go to other peoples houses. thus just say you were merely feeding it, you don;t know who's cat it is, or where its from or lives.

Normally leasehold is for 99 years.

Leasehold, as opposed to Freehold, is usually applied to properties like blocks or developments of private flats.
The property is yours for 99 years but there are usually conditional attachments to your lease.
Some of those attachments, usually, may exclude pets and children etc from taking up residence and also include liabilites such as monthly payments for various types of maintenance and even contributions for a live in caretaker or doorman to carry out various duties within the environs of the property or properties.

Obviously, on top of these liabilites, you will also have to pay council tax for the statutory services provided by local government agencies and law enforcement.

This is completely correct, it's a lot like the TV licence issue! Just deny all knowledge of a cat, it'll be your word against the other person, and there's no way it'll even get close to going to court.

It does seem rather harsh as a reason for trying to force you out.

The trouble with leasehold as opposed to freehold, is that although you own your property, you don't own the land it is built on. Even if some leases are due to expire, there are normally clauses that gives you the power to extend the terms.

I think that under the circumstances and given the fact that they do not appear to be very approachable, you go to the CAB or a solicitor with a copy of your documents to see if there is a way of fighting it. Your mortgage lender may also have some driving force to as they have obviously got an interest in your property.

Good Luck, I am sure with a bit of persuasive charm, they can be shown the error of their ways. I rented once which stated no animals. I had three dogs and two cats, but they were my family, they wouldn't expect you to drop your kids off at the orphenage would they??
