View Full Version : Advice on my car insurance 'debt' please?

Hi, so i payed for car insurance for one year and when that year was up i did not renew because i was selling my car and have now bought another one and have payed for insurance with a different company. The old company is now sending me warning letters saying i owe them £107 becuase they kept on charging me after my insurance had ran out, whic i didn't give them permission to do, it was only a one year payment i made in the first place.
So i don't owe them this money, they said they tried to take payment from my bank but my bank wouldn't let them without my authorisation.
They arn't allowed to charge me this are they? They can't carry on charging me for insurance i didnt ask for right?
Any help on what things i should say in the letter to them would be good.. if you can understand what i wrote. :confused:

hey, the contract is really long, but i have just found this, so i didnt see it when i took out the insurance, now its seems dumb i know, it says:

"Automatic renewal
We reserve the right to automatically renew this
policy and we will take the payment from credit
card unless you give us other
instructions. The credit card details overleaf will be
kept on our records for that reason. We will also
keep the information you've given us so that we
have a record if you want to make changes later on.
To opt out of our automatic renewal process
simply call us on 08705 845050 at any time."

So is there nothing i can do now? i didnt see that when i first payed it so i didn't realise i had to opt out of their scheme. Would you guys pay it if you were me? I don't think its fair, anyone know what i can do?

Was this policy taken out over the phone? If yes you have signed nothing.

Write to them recorded delivery. Agree to their request for payment upon proof of claim. Ask for the following.

1. Verification. Ask for book keeping entries to establish a debt exists.
2. Validation. Ask for a copy of the bill.
3. Law full Terms. Get them to provide a copy of the contract signed by both parties.

You are within your rights to ask for this information. If they can't provide it tell them to bugger off.

loren this same thing happened to me...i didnt renew car insurance, but company tried to take it from my credit card, but thankfully it had nowt on it ;) - i then got letter saying i owed 90 odd quid

nasty trick...but wez gave some simple but great advice there

No, I would not pay it. In any case, as you don't own the car, the policy details are incorrect, as you are no longer the owner. Any renewal contract is completely void. Do not agree to payment.

Point out to them that they have now received "other instructions".

Don't worry about it. Such clause are legally worthless and not-binding unless they have been brought to your express attention first, as they are unusual. Where a contract clause is unusual, or punitive, it has to be brought to your express attention before it can be enforced. Such clauses are therefore hardly ever enforceable. In this case, because you don't own the car, you don't even have to rely on that defense. Tell them to get stuffed.
