Right, quite a suprise it was, trying to log into my ebay account, and was told [via a Notice] I was no longer a registered user, and that my account was suspended. Reason why? ...an ex friend had used my details to base her new shop on [theprojectnandi2] after she had to shut her old shop [thenandiproject] due to her disasterous running of things.

They say I should send them copies of two ID docs, such as drivers license etc so that I can prove I am not part of this. But why the fuck should I??

But hang on....I have a 100% rating of 365 stars. If my details were being used...why have I not received any emails from them regarding my new shop? Have already brought up the matter of IP address'

I wanted to reply that I accepted their Notice, but I now serve them a counter notice.... but thought it best I should come on here and get some advice....I really want to dispute this shit treatment by this ex mate and ebay themselves.

Any advice appreciated....

Sorry...but how about investigating the shop owner first, to eliminate me from their enquiries? ....or am I just too old fashioned?

Ok....soz to bang on about this...but this is my first attempt, and I have literally just started to read up on Common Law

I have sent the following email to Ebay......is it ok?

Notice re Identity Theft of "misscaine"‏ -I changed the subject line to this, ie serving them a notice now
From: [my email addy]
Sent: 17 May 2009 16:09:23
To: ukrswebhelp@ebay.com

Hello Ebay

Well it certainly is frustrating, as I have been a 100% rated customer for over 5 years now. Ms [Lying Cheating Bitch] of Bolton, Greater Manchester, has not had a good record of trading with Ebay, under her first shop "thenandiproject" and nor her second shop "theprojectnandi2", yet it is I who is being distressed by her actions, and Ebay's handling of the matter.

However, I conditionally accept your Notice, my conditions being these:

1) You seek to investigate the shop owner of "theprojectnandi2" fully, and lawfully.

2) You inform me of all the details relating to my alleged involvement in this case, so that I may make an informed assessment of the situation, and therefore take the necessary actions.

Unless you specifically decline my conditions within 7 days, I will assume that you agree to them.

I am also serving you Notice, with regards to negligence in the handling/protecting of my personal details. If my details were being used, by an Ebay member, already familiar with yourselves, then why was I not contacted, verified or warned of such actions?

Until my conditions are met, I cannot consider sending copies of sensitive, Statute legal documents to Ebay.

Kind Regards

[Me]

Was that ok?

I can relate to these issues...........
I have been an ebay seller for 4 years and have 2 shops............and lots of headaches.
Only this week they took an item of my site for they say 'Being sexually explicit material'. It was a dozen terry toweling nappies for a newborn baby. They then decided to put this against me by saying this could lead to me being suspended if I was to do this again.
Now, either I am missing something here or the people making these decisions have odd sexual ideas!

I got sent a suspension even though I am not a member, when I checked the link it was not ebay, so I deleted it, check the link in your mail, and see where it is going.

Hi Mate

Dont know if this is relevant to your issue but about 3 weeks ago i recvieved an email from Ebay saying my account had been suspended as they bleived a "3RD PARTY" had accessed my accoujnt to send multiple emails to users, similar to spamming using my account. I changed my log in details, and ended up doing all sorts of stuff like deleting my billing info from paypal ect. I emailed Ebay cusomoer support and exchanged emails with them asking how they blelvied someone had accssed my account and they said they were not at liberty to disscuss there security procedures. Fingers crossed that now i have differna tlog in details it has rectified the issue. caused me a hour or so of anxiety though !!!

Hi all...thanks for the responses...

belladonna.... oh yes ebays stupid ideas on things...a telling projection perhaps :rolleyes:;)

jp13 and tribe of david... oh yeah....I thought it was just a hoax at first as I have ppl setting up shop on my name before, but when I saw the shop name of my ex friend. Then I knew this was for real. but thanks for the info :)

boston C danmark - think you are right, it makes it easier for them for the real slim shady to stand up and send in the docs, than it does taking down any other route. Funny how I have never been advised to contact the police, or that this would be their course of action. Well I have addressed this in my recent correspndence with them ;)

Anyway, yeah the advice you gave kinda made sense...I am just wading myself through all this, but things are sinking in. I guess once it does, none of us would ever need a solicitor/lawyer again.:rolleyes:

Ok so this is the respnse from them....

Hello Carel, Thank you for writing back to us regarding the suspension of your eBay account "misscaine". I'd like to explain why we aren't prepared to consider your account for reinstatement at this time. The safety of the eBay marketplace and our members' security are our topconcerns. For that reason, we require eBay members to always provide valid and complete contact information. This enables effective communication between eBay members and between eBay and its members. If we are unsure about the accuracy or authenticity of a member's contact information, we will often require the member to provide documents to verify such information. As explained in our previous email, we are asking you to send us copies of documents that will confirm some of the contact information you've given us. I'm afraid we won't consider your account for reinstatement until we receive the requested documents. Please refer to our previous email for information regarding your suspension and the documents we require in order to review your account for reinstatement. Please be assured that we treat your personal information with the utmost care and that we observe all necessary data protection requirements. Our customer support staff will review your documents purely for the purposes of internal administration. We always destroy documents after we've reviewed them. We look forward to receiving your documentation so that we can resolve this matter as soon as possible for you.

Kind regards,
George ClaudeeBay Trust & Safety

(notice how he didnt actually acknowledge the main points in my email and also made an assumption that I want to be reinstated...er no)
anyway I replied back....

Hello George

I understand your position on the matter, however, I do not know where I asked for my account to be reinstated. Could you point that out for me, please?

If you always require members to provide valid and complete contact information, then why did this not raise alarm, as you know Sharon Hoole, who had opened another shop with yourself previously. I ask again, why if my details were used, was this not confirmed with me?

You are trying to divert the blame onto me and yet will not say what details of mine have been used. I am afraid all I have read from your email is alot of avoidence and not direct replies to my former notice.

Therefore, may I politely remind you of the notice I sent to you.

I would also be happy for a police officer to visit me at my residence and interview me, where I can show him the originals of the statute documents you request. I could then ask them to become involved in investigating Ms Hoole, as I am not getting cooperation from Ebay.

Kind Regards

Carel

.....and so it goes on pffft..... it is a good job I have time on my hand isnt it :D
