A lawyer representing one of the men convicted in the Pirate Bay trial has called for a retrial after reports that the judge was a member of the same copyright protection organisations as several of the main entertainment industry representatives.

Defence attorneys in the Swedish case regarding the Internet file-sharing service Pirate Bay are demanding a re-trial after reports that the judge, who had to decide on copyright infringements, was a member of the same Copyright Association as several entertainment industry agents who took part in the case, according to Swedish media.
The lower Swedish court found the organisers of Pirate Bay guilty and sentenced them to one year in prison and a fine of DKK 18 million for having helped users share pirated music, games and videos using a file sharing system. The sentences have been appealed.
Judge
It was Swedish Radio that discovered the judge’s private membership of the Swedish Copyright Association. He is also a board member of the Swedish Association for the Protection of Industrial Property. The judge himself is reported by Swedish media as saying that the Copyright Association works to disseminate knowledge about copyright and is not a pressure group.
“The court case is a farce. It would be an insult to the public if the case isn’t re-tried. The general public must be able to have faith in the legal system,” Peter Sunde, one of those found guilty in the case, tells Swedish Radio.

I've actually read alot of that sort of stuff - it made perfect sense when I read it, but I couldn't recall any of it a day later!
Back on topic, if there's a retrial, what are the chances of getting a different ruling on the case, I wonder?

Well i really do hope they are not charged. I think it will change music as a whole.
But like i always say, the artists need to drop the major labels and do everything themselves. Start their own record label. Its not difficult. Then distribute their music online for sale.
I for one download lots of music for free. But as an artist myself i know how it is. WHen i download music i download to see if its good or not. If its good i buy it because you have to support the artist so you get more music from them. If you dont, then some artists will stop making music.

Of course he was biased. The elite have it out for the people running the Pirate Bay. They are pissed off that it's taken this long to get these guys, that it's so hard to shut down the site, and that the information being distributed through the site (in particular radio shows that aren't on normal radio) is doing them a great deal of harm in the public relations department.
Too little too late, though. They can try to take it away, but they know what they're in for when they start going for the jugular like that.
The "entertainment industry" is dying and just hasn't figured it out yet. Intellectual property should not cost money, and it will not cost money in the near future. Ideas cannot be sold. They should be shared to be enjoyed by the rest of the human race. The way I see it, if you are making art to make money, you aren't making art. You are making propaganda and/or product.

That explains it. Was wondering what exactly they had on them, and it seems they had a judge on them :rolleyes:
Of course artists needs to sell what they make, but many who download movies, music and so on are actually buying more media stuff than those who dont. At least according to some research that had been made.
Many movies even get a kind of free advertising this way and the same goes for series. Some of the producers are even quite aware of that. Low budget movies with a meager marketing budget are quite happy for the extra attention they get through sources like the pirate bay.
I usually dont buy movies or games without having tried a pirated version first. Demos are just not enough, and the trend these days is that demos arent made before a month or two after the game is out.
1000-0 to the pirate bay so far it seems. The copyright folks are really beginning to aim low to get them convicted of doing anything illegal.
Oh yes, btw. The pirate bay is also very good at spreading documentaries, books and other stuff related to what is being discussed on this forum. Free energy, illuminati, religion background history, spiritual stuff and so on.
