got a stop by police for speeding. was a lovely officer of the peace. i got out of the car, locked it and approached him and bade him good evening. he asked for my licence of which i gave, he showed me a gun and the alleged speed of which he said i was driving at. i smiled. he asked was i the owner i replied i am the registered keeper i believe, he asked again and i repeated. he looked at the discs displayed on the car, all in order as recommended in the road traffic act.
\
he then said i will be reported for speeding and will get a letter in the post, 80euro or two weeks later 120euro. i smiled and asked would it be a notice. he said yes.

i bade him good evening and we went on our way.

All in all it was a pleasant experience.

i look forward to getting same notice, i will keep the forum informed and welcome any advice or comments.

Once you receive a notice it will be nice to see it (with your details removed) so we can all pick it to pieces :D one thing that I would recommend in your notice to them following theirs is to request a bill that meets with the requirements of the Bills of Exchange Act 1882.

We eagerly await...

Did he issue you a ticket then and there?
If so, did he give you the original or the copy?

I'm interested in whether or not you were driving dangerously to others , if you see what I mean.

I have a bike which is more than capable of exceeding any speed limit in britain (where I live) and enjoy using its performance but I'm always conscious of others so what I'm thinking is if you didn't see the cop with the gun in time to slow down to a respectable speed then do you deserve to be penalised?

I drive a very small car. i was going, he said, 10k over the 100 limit. there were no other cars on the road and i was driving safely, i was in no hurry to go anywhere.

he was behind me in his patrol car. it was dark.

I actually received a ticket a while back and actually had to go to court due to the new law, but in the court the cop_ass that pulled me over literally snickered at me. I had to go to driving school too  Got to love the police state. :)

In Britain you can get away with ten per cent over the speed limit, so john would not have been pulled (more than likely) and it does not sound to me , from your reply, john , that you were about to cause harm or loss to another so.....you 've already enjoindered yourself with your person when interacting with the politely described peace officer therefore your next opportunity to disassociate your wealth from proceedings will be when you receive a letter from the SYSTEM:eek::D

If I were you, this would be my first attempt at using my newly found knowledge to challenge 'their' perception of their power over me, but seeing as I don't even know what country you're from then I'm in no position to give you advice, just to wish you well on your journey:)

my ex did 33 in a 30 zone and got a 30 quid fine about 8 yrs ago,

so petty , anyways i have an opinion on speeding.

who said doing say 40 in a 30 zone is speeding? the law society did , so going faster than 30 is not really speeding as its sumones limit as they describe it.

im happy doing 40 in a 30 as long as i feel its clear and people free. no one has the right to tell me what i can do in relation to my life , that would be breaking my birth rights.

being a freeman is about taking control of your life and living it responsabily and if any freeman kills or hurts another cos they were doing 40 in a 30 has to pay the price , not just criminally but in the mind too for the rest of there lives.

Hi John Doe, i'm Oirish too.. (what a great day saturday was, by the way!)...
Yeah, as far as i know, asking for the bill is the right action to take, although ive no real experience in that field. (the only things ive managed to discharge are parking tickets, and that was before i started learning this stuff, just using their own statutes against them).

Id like to see how it pans out for you, since i haven't had the opportunity to try any of these baby steps yet..

hey barfly, how did you get those parking tickets discharged? was it by asking for a bill?

When i had the tickets quashed was before i'd even heard of the freeman concept, but what had them done away is covered in the methodology.

I got several parking tickets and didn't think it was very fair because I had no choice but to park my car in a pay parking area because of where I was living. I applied for a permit and everything and was turned down. That pissed me off. So I sent a letter to the local council outlining that i believed that i had the right to park where i was parking etc because it was within the vicinity of my home, and quoted legislation that permitted this from other county councils.

Anyway, 8 months passed and i received no reply from the county council, until I got an invitation to attend court for a few of these parking tickets that had built up.
I sat in court for seven hours waiting to be called, and when I finally was, I informed my judge of what I believed were my rights etc, and that I had written a letter to the Roads Dept of the Council in April to this effect. The Judge then asked if the council had responded to my letter, and when I answered "no", he just threw out all the parking tickets.

I didnt realise until I started looking into the freeman stuff that the real reason i think it was thrown out (without even looking for a response from the council, i might add), is that they were automatically in dishonour for not continuing correspondance with me, and so had no case against me... either that or he might have seen that they implied to accept my beliefs as to my rights by not responding to my claim.

As I said, i had no idea whether I had a leg to stand on going into court, but i was damned if i was gonna let them extort money outta me, especially since i'd been made redundant a few weeks earlier! Needless to say I walked out of that court feeling ten feet tall, and even got a small round of applause from the few people waiting to be heard after me. You shoud have seen the look on the traffic warden's face, he didn't have a clue what I was talking about when I started quoting the law, whoops, i mean statute, he was supposed to know!

I find this very interesting. May I ask you which Council this was? Normally when a Council issues parking tickets (PCN), as opposed to the police (ECN) it is under the decriminalised scheme, and it cannot end up in Court, it isn't possible. A PCN is just registered at the TEC. An ECN from the police will end up in the magistrates. Was it the Magistrates or County Court?

District Court, Co. Laois. I think you're referring to British procedure?

sounds like dishonour doesnt it. im delighted to hear that. ill work on the bills of exchange act with my case but am green. i got the gist of it tho, acts is contract law. and contract requires consent. simple really. its great to hear of someone so close.
