View Full Version : letter from dwp this morning
hi all.
a had a letter this morning from the department for work and pensions dwp.
stating about the £134.10 that i apparently owe them????
I am writing about a debt that our records show is outstanding.
debt management, part of the department for work and pensions, is at presant responsible for collecting this money.
however, your case is now being considered for immediate transfer to a private company for repayment collection.
please get in touch with us straight away on (number provided) to discuss a repayment schedule for the amount still owed. if we do not hear anthing by 09/03/2009 the case will be transfered for collection by a private company.
if an arrangement to pay is made but regular payments are not made the case will be transfered. if a payment is made but DWP are not concated to discuss an ongoing arrangement the will still be transfered.
yours sincerely

Isn't it amazing how you can suddenly come up on their radar, when you're not even within its range? :)
If it is a letter, you can simply ignore it.
However, they will probably continue to harass you.
You could send them NOTICE requesting proof of claim.
Ask them to show the alleged debt.
A little bit of "rock and hard place" ...
Ignore them; they'll just keep bugging you.
Serve Notice; it might be the start of a beautiful friendship.
Not much help I know.
In the back of my mind, I have this nagging question of "why contact you"?
It's like those letters being served by the Councils that people are showing ... where they are suddenly being threatened for legal action and legal charges on council debts that do not exist.
A pattern is definitely developing.

possibly someone who knows this about you has been using your NI number to claim benefit? they have incurred the debt and the DWP did a search for your name and found your current address?
i thought that too. why all of a suddern am i being contacted for things i do not owe. i had a another letter ooh about 8 weeks ago now asking if i would like to send them £43 to top up something to do with my national insurance contributions. something to do with my pension, well no actaully i dont feel like sending them 43 quid for bugger all lol i never think that far ahead, i might be dead before i even get a pension anyway.
i think i'll just ignore them for now because i dont get all this legal jargon and would probably dig myself into a deep hole and make the situation worse.
they can whistle for the money because i do not owe anyone anything. i never get into debt, everything i own is mine..paid for with cash. if i cant affored something then i'm not ment to have it in the first place.
i doubt that someone is using my ni number
screw you DWP oh and kiss my arse! :D

i got one of those when i was signing on, i think it may have come when i was put on a new deal scheme and kinda 'signed off' for 6months while under the 'self employment' scheme. i signed back on after the 6 months.

Last summer i received 3 of these letters all addressed to differnt people, one in my name, one for a previous tenant of over 5 yrs plus, the other completly random.
They were all for the same amount £129.50.
I ignored them at first but they kept coming every week,i did contact the DWP but once i did they insisted i pay, which i did,i mentioned the other addressee's they had sent and i told to ignore them.
It may be that someone who was a previous tenant at your home may of owed the money.
As soon as i paid the amount all letters ceased, seems to me that they are trying it on and don't care who repays the money as long as the debt on the address is cleared,i think i paid some ele's debt.:(
I wouldn't ignore it, it probably is some toe rag using your address, but if you ignore them they will just get heavy.
Definitley phone them, but record it as they will be recording you, you can probably clear it up on the phone, or if they want to see you, get them to come to you, not the other way around, and have a witness for the call etc.
If you don't want to talk to them yourself, you can alway get someone else to call on your behalf.
I definitley would not pay them, if you are sure you don't owe them why would you pay for their erroneous behaviour.

exactly! i do not owe them jack. they obviously know that i have'nt paid into their system for a long time or taken anything out from it. they just want some sort of payment off me for what ever it seems like to me. they can take me to court if they like...i don't even have a bank account lol ..not in my name anyway.. they cant get blood out of a stone can they.
it would cost them to take me to court so it would probably be dropped?
on a slightly different subject but related a friend of mine got a phone call from electric supplier and was asked to read her meter which is a key meter . They then told her she owed £750 as they had charged her the wrong tariff since 2004 .She told them it was their mistake and she wasn't paying .They said she was going to as it was her debt , to which she said Fuck off ! they said dont take that tone with us .They sent her a new key with the debt on it and told her not to use the original . She phoned the law center to ask abut her position . They told her she was in the right so she refused payment and insist they send her another key .Two new keys arrived same day not stating which was which ! obviously hoping she would use the debt key and therefore be liable .She asked for a new key and they sent one and a letter stating they waived the debt . They could only go back to 2006 for reclaiming debt anyhow she was told .
How many people pensioners for example get this type of treatment and pay up ? Always question everything:D

Just be sure that you don't give them any information that you do not want them to have!
Protect name, DOB, etc.
They will try to fool you by quoting some bullshit about it being "for security purposes" ... but lets get real ... THEY sent you a letter, which should have a reference number on it ... how much "security" or "personal data" is going to be involved, when some one is calling them about a freakin' DEBT (alleged) quoting a specific reference number ???
Where is the security breach ?
:D
Sometimes we fall for these traps because we've been programmed to.
However, when you stop and think about it - its a JOKE!
Let's just imagine how this phone call might sound ... just as a hypothetical exercise :D
Yes .. I'm calling about a letter and alleged debt you sent me ...
No problem - please give me your full name, date of birth and address ...
Ummm ... why?
For security reasons sir ... part of the Data Protection Act
Well, I don't want to give you that info - I just want to know why you sent me a letter alleging a debt is owed.
To do that, I need you to confirm your details to me.
Ummm ... didn't you send me the letter?
Yes ...
Ummmm ... and isn't it you who would want me to pay this?
Yes ...
Then for me to pay it, you need to tell me why you even sent it.
Well I will sir, when you confirm that information for me.
And if I don't?
I'm sorry?
And if I don't agree to surrender that information?
Then I cannot give you the information.
That's fine by me ... the burden off proof of debt is on you ... not me! I do not have to prove I owe the alleged debt - you have to prove that I do ... so if you are unwilling to provide me with the info ... then I guess we'll just leave it at that then ... have a nice day ...
Ummm ... so you will pay the debt then?
No. You haven't given me proof I owe it.
But how can I if you won't give me your details?
Well for starters - you sent me a letter, I quoted you the reference number ... so you must be satisfied that you do have my details or you would not have known who to send a letter to!
But I need you to confirm them for me, so that I can check the information.
So without my details, you can't prove the debt?
Yes.
Then I definitely won't be providing the details!
What?
As I said, the burden of proof is on YOU to prove the debt - not for me to prove I owe it ... I'm certainly not going to give my details if you will use them against me on an alleged debt that you have not provided me with any proof for ...
Ummm ... but I need that information to proceed with the call.
Then I suggest we end the call now ... thank you and goodbye :)
They need to start playing by OUR rules.

the refrence number meaning my national insurance number? thats the reference number. if i confirm that number i'm basicly conecting myself to the person right?
i love the way they have wrote in bold font about the £134.10 still owed that means it does not exist right?

See they try it on al lthe time . Question everything .How are you doing anyhow with the health regime? :D
If you intend to send them any letters or get into any kind of correspondance with them, i'd advise using this forum for advice: http://www.consumeractiongroup.co.uk/forum
They seem to be helping a lot of people in situations similar to yours.

thats great thank you sean
what is amusing about the letter is that they have wrote it to a Ms and my fictional person is a Miss so really the letter is'nt even address to my person is it.

Good for you , yes half the battle is in the mind . Think right act right . that includes the foods we eat . Do try the essiac (wether it tea form or tincture) that was my main source and it worked well for me long before i added the b17 apricot kernals .
so i've just come off the phone to a very pleasant girl by the name of katie.
i think i did ok.
she bascly wanted me to comfirm that it was me.
i explained that i was a human being and not the person as the person is a fiction. we went through the old well i need to confirm that you are the person for security dpa reasons. i explained that it was not a security issue as i'd just given her the referance number. she replied but that letter could be sent to the wrong person, so i mentioned why would anyone want to phone up about an alledge debt if it had nothing to do with them.
anyway it carried on for a while and apparently it was from an overpayment of job seekers from years and years back that i had signed for. now why would i sign a piece of paper to claim an overpayment lol. why would anyone sign for an overpayment.
so i said that she has to prove that i had the money in the first place to which she replied no, you have to prove to us, i replied but if that was the case you could write to every person in the country saying that owe money and how could they prove there innocence so you have to prove that i did have an over payment.
unless you can find the original paper work with my signiture on it then i wont be paying anything because you can not prove anything.
she said ok well i will have to see if we can file. she also said that they could send me a copy of the paperwork i signed, i replied but that will not be the original piece of paper. i will have to see the original paperwork to prove that i did sign it.
oh we cant send you the original piece of paper because you could destroy it lol. well how about you find the original piece of paper and i will come in so i can see it with my own eyes and if i have signed it then fair enough.
oh you can't come in to our buildings, then how am i supposed to see if i signed it or not? ..
so its still in the air because she now has to find that peice of paper lol but as i've mentioned ..why on earth would i sign for an overpayment in the first place.
another thing i mentioned was the fact that they kept stopping my claim for no reason at all. they really had it in for me from day one, so much so that i had to make at least 10 claims which ment i lost alot of money so i mentioned that they actually owe me about a thousand pounds which i might want to claim back if they are going to continue harrassing me.
find that piece of paper katie :D

LOL ......they're on a little fishin expedition they chuck out a few o these letters every now and then for the cost of a few stamps and they wait to see who bites if you get in touch. They know that more than likely you'll contract and BINGO your in the Sh..tter.
You could do A4V on it I suppose and send a copy back to them after sending the original to treasury with the correct instructions and information on how to access your pre-paid bond account that you have previously set up the way you wanted and in a fully charged state and simply instruct them to effect payment on the thing to whatever value they wish it wont matter to you right ? as you are worth billions and billions............no fiction can withstand one truth....!!!
peace ( oh and do more research :-) )
