The sister of a Flagler Beach woman strapped into
a restraint chair by Flagler County jail deputies
has broken the family�s silence on the matter.

Carmel Tanner Tomlinson, daughter of local State
Attorney John Tanner, is challenging written
statements by jail guards who said they strapped
her sister, Lisa Tanner, into a restraining chair
because she posed a danger to herself and to other
guards after her arrest in March 2005.

What really happened, Tomlinson wrote in a pair of
e-mails to The Daytona Beach News-Journal dated
April 27 and May 2, was that Lisa Tanner refused
orders to take a shower and didn�t want to use a
toilet in view of the Flagler Beach officer who
arrested her that night.

That officer, Nathaniel Juratovac, is the subject
of two civil lawsuits by motorists who claim
mistreatment in separate 2004 traffic stops.
Attempts to reach Juratovac for comment were
unsuccessful.

The Lisa Tanner case is under investigation by a
special prosecutor, Jerry Hill of the 10th
Judicial Circuit in Polk County, who has convened
two days of grand jury hearings in Flagler
County.

People involved in the case, including Hill, Lisa
Tanner, John Tanner and Flagler Sheriff Don
Fleming, who oversees the jail, have declined
repeated requests to comment on the matter. State
law prohibits prosecutors, witnesses or jurors
from discussing details of ongoing grand jury
investigations.

The sheriff disclosed the Hill investigation last
week. And Thursday, Fleming said he removed the
jail administrator from his post after a female
jail guard was charged with pepper-spraying an
inmate who was strapped into the restraint chair
in July 2005. That administrator resigned Friday.

Charges against the guard stem from a separate
investigation by John Tanner into all uses of
force at the jail since Fleming took office in
January 2005, Fleming said.

The e-mails by Tomlinson take issue with the
newspaper�s description of events in a videotape
of Lisa Tanner�s restraint released by the sheriff
last week, as well as written statements by guards
involved in the restraint.

In the April 27 e-mail, Tomlinson contends
"the only reason Lisa is put into the
restraints is because she will not take a
shower."

In addition, Tomlinson asks why Juratovac, the
arresting officer, did not leave the jail after
arresting Tanner at her Flagler Beach home on
charges of disorderly intoxication and resisting
arrest without violence on March 24, 2005.

Lisa Tanner had asked for Juratovac to leave so
she could use a toilet visible through a window in
the holding cell, Tomlinson wrote.

In a written statement about the incident, Cpl.
Brian Pasquariello wrote that guards decided to
place Lisa Tanner into the restraint chair after
she "banged violently" on a window from
her holding cell and screamed at the
"arresting officer."

That arresting officer, Tomlinson wrote, was
Juratovac. "What was he doing in the cell
area where she was confined?" Tomlinson
wrote. "He was refusing to leave the area
when she requested to use the bathroom."

A video of the events involving Lisa Tanner,
released last week by the Sheriff�s Office, shows
that during her initial restraint, she gestures
numerous times to an unseen "pervert"
beyond the camera�s view, names Juratovac and says
she does not feel comfortable with him being
present.
