Madeleine McCann book appeal lost by detective



A Portuguese former detective has failed to overturn a ban on his book about missing Madeleine McCann, a spokeswoman for her parents has said.

Gerry and Kate McCann said Goncalo Amaral's book defamed them and hindered their continuing search for Madeleine.

The book suggests Madeleine, who went missing from an Algarve holiday flat on 3 May 2007, aged three, is dead.

The couple, of Rothley, Leicestershire, welcomed the decision by a Portuguese judge, saying they were "relieved".

Mr Amaral was the initial head of the police investigation into Madeleine's disappearance but was taken off the case in October 2007, following his apparent criticism of British police work on the inquiry.

His book, Maddie: The Truth Of The Lie, which was originally published in July 2008, also questions the couple's accounts of theur daughter's disappearance.

In September 2009, a Portuguese injunction temporarily banned sales and further publication of the book as well as a DVD version of it.

Mr Amaral launched a bid to overturn the ban last month, calling a series of witnesses to support his claims.

But Judge Maria Gabriela Cunha Rodrigues, sitting at Lisbon's main civil court, rejected his challenge.

Mr and Mrs McCann said in a statement: "The court case has demonstrated, once again, that there is no evidence that Madeleine has come to any harm.

"It has also clearly shown that no police force is actively looking for Madeleine, even, shockingly, when they are presented with new information and leads.

"The motives of those who have tried to convince the world that Madeleine is dead, and who've disgracefully and falsely tried to implicate us in her disappearance, need to be seriously questioned."

The couple also called on the British and Portuguese authorities to continue to search for their daughter.

Mr Amaral's lawyers said the material in his book came from official police files for the investigation, many of which were made public when the case was shelved in August 2008.

The McCanns are also seeking 1.2m euros (£1.08m) in compensation for defamation in separate civil proceedings against Mr Amaral in Portugal.

The former detective previously said if he lost the case he would take an appeal to the European Court of Human Rights.

Godgoo, there is no physical evidence in this case that the child was abducted, it's just the parents that try and perpetuate this story and unfortunately it is more likely that the child is dead than anything else. Maybe you just can't contemplate how it is possible for a parent to harm a child, I agree it's hard to understand but....

Statistics of missing/murdered children are not looking favourable for the (ever vigilant and attentive :rolleyes:) mccanns. Have a look at the statistics, then read a copy of Amarals book. Why should he not be able to publicise the results of his investgation?

I nearly didn't share it, david as I know the evidence points to the fact that Maddie is dead and I think that is the most likely. I think what brought me to have these thoughts was, as you say, the behaviour of the McCanns. I would be overwhelmed with guilt and grief for just having left those children alone in the apartment, however close by they were dining. It is so irresponsible.

And then today on Sky, I heard Kate McCann describe her daughter as vulnerable ! Too right she was vulnerable, along with Sean and Amelie, to have parents who would leave them alone like that. A fall out of bed onto a marble or tiled floor, a cracked skull or something else broken, choking on vomit - anything can happen to young children and that is why parents should always be on hand, not putting their own interests and comforts first.

On those grounds alone this whole thing stinks to me. I just cannot comprehend parents who behave like that.

I have read one of the books on this case and the balance of probability says she is dead, possibly died from a fall from the back of the sofa and now it is being covered up.

This does though raise even more questions. If you child fell from the back of a sofa and you found her would you not want to help and get help?

Who was that man seen by the British tourists carrying the little girl late at night? Why did the McCanns and their friends leave their children alone? Why did they walk the very long way round to look in on the children when there was a much shorter route through the balcony.

Why did the cadaver dogs find evidence of death behind the sofa and in the cupboard in the McCanns bedroom - which incidentally not the bedroom that Madeline was not sleeping in?

Why was evidence of a body found in the boot of a hire car that the McCanns had hired 21 days AFTER her disappearance?

These are just some of the inconsistencies that need to be addressed.

I think what brought me to have these thoughts was, as you say, the behaviour of the McCanns. I would be overwhelmed with guilt and grief for just having left those children alone in the apartment, however close by they were dining. It is so irresponsible.

And then today on Sky, I heard Kate McCann describe her daughter as vulnerable ! Too right she was vulnerable, along with Sean and Amelie, to have parents who would leave them alone like that. A fall out of bed onto a marble or tiled floor, a cracked skull or something else broken, choking on vomit - anything can happen to young children and that is why parents should always be on hand, not putting their own interests and comforts first.

On those grounds alone this whole thing stinks to me. I just cannot comprehend parents who behave like that.

The woman who lived in the Flat above the McCanns flat reported that a child was crying in the flat below her for 90 minutes the previous night (at around about 10 o'clock in the evening).
